Recruitment runs on trust. If you share information with ETISK, we use it carefully, for clear reasons, and only with people who genuinely need it.

This policy explains what we collect, why we collect it, who we may share it with and the choices you have.

About this policy

ETISK is the recruitment brand operated by Ecommerce Recruitment Pty Ltd (ABN 25 668 200 431), an Australian private company. In this policy, “ETISK”, “we”, “us” and “our” refer to Ecommerce Recruitment Pty Ltd trading as ETISK. This policy applies to personal information we handle about candidates, prospective candidates, referees, client contacts, prospective clients, website visitors and people who respond to our advertising or lead forms.

We handle personal information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply. This policy is intended to be clear, current and practical.

“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

What personal information we collect

The information we collect depends on how you deal with us. It may include:

  • Identity and contact details: name, email address, phone number, location and professional profile links.
  • Candidate and career information: CV, employment history, qualifications, skills, salary expectations, availability, work preferences, interview notes and information you choose to share about your career.
  • Recruitment checks: referee feedback, work rights, licences, credentials and other screening information where relevant to a role and permitted by law.
  • Client information: business contact details, role requirements, hiring plans, communications, commercial arrangements and feedback relating to a recruitment process.
  • Advertising and lead-form information: information you submit through LinkedIn Lead Gen Forms or another advertising platform, such as your name, email, phone number, job title, employer, location, profile link and answers to form questions.
  • Website and technical information: IP address, browser and device type, pages viewed, referral source, approximate location and similar diagnostic or usage information.

We may collect sensitive information—such as health information, disability information, racial or ethnic origin, or criminal-record information—only where it is reasonably necessary for our work and you consent, or where collection is otherwise authorised or required by law. Please do not send sensitive information unless it is relevant and requested.

How we collect information

We usually collect personal information directly from you when you:

  • email, call or otherwise contact ETISK;
  • apply for a role through an ETISK job page or an external applicant-tracking system such as Atlas;
  • submit a LinkedIn Lead Gen Form, enquiry form or social-media response;
  • send a CV, LinkedIn profile or portfolio;
  • take part in an interview, assessment or recruitment process; or
  • engage ETISK to recruit for your business.

We may also collect information from referees, employers or prospective employers, professional and social platforms such as LinkedIn, public sources, referrals, service providers and other third parties where you have consented or where collection is reasonably expected and lawful.

LinkedIn Lead Gen Forms

If you submit a LinkedIn Lead Gen Form, LinkedIn provides ETISK with the fields and answers you choose to submit. We use that information for the purpose described in the form—for example, responding to a hiring enquiry, discussing a role, or keeping in touch about relevant opportunities. We do not receive your LinkedIn password. LinkedIn separately handles information under its own privacy policy and platform terms.

How we use personal information

We may collect, hold, use and disclose personal information to:

  • respond to enquiries and communicate with you;
  • understand a client’s business, team and hiring requirements;
  • assess suitability for current or future employment opportunities;
  • match, introduce and represent candidates for agreed opportunities;
  • arrange interviews, obtain feedback, manage offers and support placements;
  • conduct reference, work-right, qualification or other relevant checks;
  • maintain recruitment, relationship and business records;
  • improve our services, website and communications;
  • send relevant opportunities or business updates where you have consented or where permitted by law;
  • protect our systems, prevent misuse and resolve complaints; and
  • meet legal, regulatory, insurance, accounting and professional obligations.

If we want to use your information for a materially different purpose, we will seek consent or ensure the use is otherwise permitted by law.

Who we may share information with

We treat personal information as confidential. We may disclose it where reasonably necessary to:

  • clients and prospective employers considering a candidate for an agreed role;
  • candidates who need relevant information about a client or opportunity;
  • referees, screening providers and assessment providers;
  • applicant-tracking, email, cloud-storage, document, analytics, advertising and IT service providers;
  • professional advisers, insurers, auditors and business-support providers;
  • regulators, courts, law-enforcement bodies or other parties where required or authorised by law; and
  • a purchaser or successor if ETISK is involved in a genuine business sale or restructure, subject to appropriate confidentiality safeguards.

We do not send a candidate’s CV or identifying profile to a prospective employer without first discussing the specific opportunity with the candidate. We do not sell personal information.

Overseas processing

ETISK is likely to disclose personal information to overseas recipients when we use technology, advertising, applicant-tracking and cloud providers. The countries in which recipients are likely to be located include the United Kingdom, where Atlas Recruitment Technology Ltd operates, and the United States, where LinkedIn and some technology providers process data. Providers may also use infrastructure or subcontractors in other countries that they identify in their own privacy notices.

Where overseas processing occurs, we take reasonable steps appropriate to the circumstances to use reputable providers and protect the information. Privacy protections and legal rights in another country may differ from those in Australia.

Security and retention

We use reasonable technical and organisational safeguards designed to protect personal information against misuse, interference, loss, unauthorised access, modification and disclosure. These include access controls, reputable service providers and limiting access to people who need the information for legitimate work.

No online transmission or storage system can be guaranteed completely secure. If a data incident occurs, we will assess and respond to it, including notifications required under applicable law.

We keep personal information only for as long as reasonably necessary for recruitment, relationship management, legal and business purposes. Retention periods vary according to the type of record, whether a recruitment process or placement is active, whether you want to hear about future opportunities and any legal obligations. When information is no longer required, we take reasonable steps to delete or de-identify it.

Marketing, website data and third parties

We may contact you about relevant roles, candidates, services or business updates where you have asked us to, consented, or where otherwise permitted by law. You can opt out at any time by replying to the message or emailing us. Service and recruitment-process communications may still be sent where necessary.

Our website and hosting or analytics providers may process technical information to keep the site secure, understand general use and improve performance. We do not currently use website cookies to build advertising profiles or sell browsing information. Browser settings and privacy tools may let you limit local storage or other website technologies.

Our website links to third-party services, including LinkedIn and external job-application systems. Those services operate under their own privacy policies and controls. We encourage you to review them before submitting information.

Your choices and rights

You may contact us to:

  • request access to personal information we hold about you;
  • ask us to correct information that is inaccurate, incomplete or out of date;
  • withdraw consent or ask us to stop contacting you;
  • ask us to delete or de-identify information where applicable; or
  • ask a question about how your information has been handled.

We may need to verify your identity before acting on a request. Legal exceptions may apply, and we may need to retain some records for lawful business, dispute or compliance reasons. If we cannot fulfil a request, we will explain why where required.

Privacy complaints and contact

If you have a privacy concern or complaint, contact ETISK first and explain what happened and what outcome you are seeking. We will acknowledge the issue, investigate it and aim to respond within a reasonable period—normally within 30 days.
